Two Days before the impeachment trial of 73-year-old President Donald Trump begins, Democrats have moved on to smearing Trump as much as possible before the 2020 presidential election. With imminent failure in the U.S. Senate, House Speaker Nancy Pelosi (D-Calif.), House Intelligence Committee Chairman Adam Schiff (D-Calif.) and House Judiciary Chairman Jerold Nadler (D-N.Y.) have accepted they’ll lose the impeachment battle. So, instead of admitting there’s no real impeachment case against Trump, Democrats have moved on to making Republicans look like they’re engaged in a cover-up at the FBI and CIA, refusing to release all relevant documents into public view. Schiff told ABC News “This Week” with George Stephanopoulos that the CIA and FBI have been intimidated by Trump. “They appear to be succumbing to pressure from the administration,” Schiff told Stephanopoulos.

Schiff’s already accepted his fate in the U.S. Senate, now spreading left-wing conspiracies that the reason he lost the impeachment case against Trump is because of stonewalling by important federal agencies. If only Schiff had real access to more classified documents or new testimony, then he could prove his case against Trump. But as Trump attorney former Harvard Law Professor Alan Dershowitz points out, Democrats have no impeachment case against Trump. What they do have is an attack on Trump’s Article 2 powers, giving him executive privilege to stop a Democrat witch-hunt in Congress to usurp the presidency. Dershowitz plans to argue that House Democrats abused their Article 1 impeachment authority, moving the impeachment bar so low that it jeopardizes future presidents from any autonomy under the Constitution’s balance of power provisions.

Schiff makes the argument that if only he had access to more documents and witnesses, he could win his impeachment case against Trump. Schiff insists that National Security Agency [NSA] “in particular is withholding what are potentially relevant documents to our oversight responsibilities on Ukraine but also withholding documents potentially relevant that the senators might want to see during the trial—that is deeply concerning,” Schiff said. Schiff’s argument is essentially he can never get enough testimony and documents to prove his case. Schiff can’t admit, as Dershowitz points out, that Democrats have no real impeachment case because the charges do not rise to impeachable offenses, including the so-called quid pro quo with Ukrainian President Volodymyr Zelensky, where Trump promised $391 million in cash in exchange for dirt on Joe and Hunter Biden.

Making the charges of cover-up by the FBI and CIA, Schiff can forever taint the impeachment trial, arguing that the eventual acquittal is a sham, fraud and fixed by Trump’s handpicked Atty. Gen. William Barr. Pelosi, Schiff and Nadler have shifted all their blame on Barr, because they have no case. Abuse of power and obstruction of Congress, Democrats’ two impeachment articles, do not meet the Constitutional standard of “Treason, bribery or other high crimes and misdemeanors.” Trump didn’t commit a crime but it’s OK for the House to make up their own eccentric definitions of high-crimes-and-misdemeanors. Pelosi, Schiff and Nadler spent months after Special Counsel Robert Mueller cleared Trump March 23, 2019 of Russian collusion in the 2016 presidential election, looking for anything possible way to impeach Trump, finally finding a so-called “whistleblower” Sept. 25, 2019.

Schiff wants to blame the FBI and CIA for not giving him more documents but won’t admit his role in concocting the “whistleblower’s” story. Schiff said he had no contact with the “whistleblower,” but later admitted he did have contact. But not on in the Democrat-friendly press wants to call Schiff out for making up stories about the “whistleblower,” claiming second-hand information about Trump’s infamous July 25, 2019 phone cal with 40-year-old Ukrainian President Volodymyr Zelensky. Zelensky denounced the “whistleblower’s” contention that Trump pressured him into digging up dirt on former Vice President Joe Biden and his 50-year-old son, Hunter. Zelensky said he was not “pushed” by Trump to do anything. Yet Democrats insist that Trump coerced Zelensky in a quid pro quo to dredge up dirt on the Bidens. Republicans don’t buy Democrats’ impeachment case.

Unable to prove their impeachment case against Trump, Pelosi, Schiff and Nadler have pivoted already to smearing Trump about covering-up key facts to prove their impeachment case. There’s never going to be enough documents or witnesses for Schiff, mainly because Democrats’ case is not about impeachment. Democrats want to smear Trump as much as possible before the 2020 primaries, giving whoever emerges as the Party’s nominee the best shot of beating Trump next November. Schiff can’t prove his impeachment case, not because he doesn’t have enough documents or witnesses but because he has no Constitutional impeachment case against Trump. Abuse of power and obstruction of Congress are not impeachable offenses. Pelosi, Schiff and Nadler are playing to undecided voters who are trying to figure out whether there’s a legitimate impeachment case against Trump
